Terms and Conditions

Families must accept our Terms and Conditions and filling in the on line family application form and submitting same will indicate acceptance of both the fee schedule and the terms and conditions.

The finder's fee covers the goodwill of JCR as an organisation and its extensive overseas network as well as the time taken in phone calls, letters, emails, faxes, correspondence and communications to finalise the match between au pair/nanny and host family. No further costs are incurred by the host family and no refund of fees is applicable once the placement has commenced.

For Australian, New Zealand and International candidates, live in, payment is due upon verbal or written confirmation and subsequent invoice by JCR, of the applicant's acceptance of the family offer of placement.

The Finder's Fee is due and payable upon presentation of invoice and prior to the au pair joining the host family.

No negotiations will be entered into regarding fees after the date on which the applicant commences work with the employer; the start date.

Late payments bear interest at the rate of 1.5% per month (or the highest rate permitted by law, if less). Charges are exclusive of taxes. The family will pay (1) all taxes and  other government charges and (2) reasonable expenses and attorneys’ fee JCR Australia/New Zealand incurs in collecting late payment that are not disputed in good faith.

Any offer of a position to an au pair / nanny will attract a placement finder's fee. All JCR Australia/New Zealand candidates are covered by a 12-month exclusivity agreement. This provides that should the client, or anybody that the client introduces to the candidate without our permission, subsequently engage the candidate within the 12 month period of the introduction of the candidate to the client, the full fee becomes payable.

Should the family choose to cancel a placement prior to the au pair's arrival after payment of the finder's fee and the family/aupair agreement has been signed, JCR reserves the right of discretion to either seek a replacement au pair or retain a cancellation fee of 70% of the paid finder's fee. In addition should the aupair have already booked & paid for her flight out, a flight cancellation fee will also be charged to the family.

JCR Australia/New Zealand endeavour to make every reasonable effort to ensure the suitability of the candidate on behalf of the client, we cannot personally guarantee references; accept liability for any loss or damage to property, expense, or loss of profit arising directly from any applicant introduced by ourselves. The client is responsible for satisfying themselves as to candidate's skills, qualifications and general integrity, obtaining visa, medical requirements or qualifications required by law.

JCR reserves the right of discretion to offer a replacement aupair should the aupair leave the position, for no valid reason as determined by JCR, within the first 4 weeks of the onset of the stated contract period, provided that the finder's fee has been paid in full, as per paragraph 4 above. Valid reasons may include, unforeseen long term illness or unsuitable working conditions. JCR will offer a replacement aupair to the family, entirely at its discretion, dependant on the circumstances. Initial replacement aupair will be free of any additional charges. Any further replacement aupairs, at JCR's discretion, during the initial 4 week period, will attract an admin fee of $200.00.  Dismissal by the family, within the 4 week period, is not covered by this paragraph unless at the discretion of the directors of JCR. However, JCR does reserve the right to charge a reduced finder's fee to replace a candidate who has been discharged during the initial 4 week period. No refund of finder's fee is applicable once the placement has commenced. Should JCR exercise its discretion to offer a replacement aupair and the family refuses this option or if the family should find their own replacement, a refund of the finder's fee is still not applicable.

JCR reserves the right of discretion to offer a replacement aupair should the aupair leave the position, for no valid reason as determined by JCR, after the first 4 weeks of the onset of the stated contract period and prior to the end of the contract period. This service will attract an administrative fee/finder’s fee to be determined at that time.  

No variations can be made to these terms and fees without the written consent of the directors of JCR Australia/New Zealand.
